Forsgren Fisher secures key victory in Title IX case

On September 19, 2025, Judge Eric C. Tostrud of the U.S. District Court for the District of Minnesota denied a motion for preliminary injunction filed by Female Athletes United (FAU) against a Forsgren Fisher client.

FAU’s lawsuit—closely watched for its novel issues at the intersection of federal and state civil-rights laws—sought emergency relief that the court determined was unwarranted. In its ruling, the court agreed with Forsgren Fisher that FAU had not shown either irreparable harm or a likelihood of success on the merits of its claims.

“This ruling is a significant victory for our client,” said partner Ginny McCalmont. “We are grateful that the court recognized FAU is unlikely to prevail and that an injunction would have caused real and lasting harm.”

The case is Female Athletes United v. Ellison et al., Case No. 25-CV-2151 (D. Minn.).
